यही वह जगह है जहाँ blind trust महँगा पड़ सकता है। This does not mean every advocate is careless or that every delayed filing destroys a case. It means that a client should not remain completely disconnected from the proceedings while assuming that professional responsibility alone will protect every deadline.

आपने अपना नाम, mobile number, address, family details, matrimonial history, property documents, financial information, medical information, WhatsApp conversations, witnesses के नाम, police complaint, court orders और अपनी legal strategy तक किसी AI system में डाल दी हो।

फिर सोचिए—

अगर sensitive information किसी ऐसे system में चली गई जिसके data handling, storage, retention, access या security arrangements को आपने ठीक से समझा ही नहीं, तो आपने अपने case की privacy के साथ क्या किया?

Supreme Court की 2026 draft Regulations for Use of Artificial Intelligence in Courts ने human primacy के साथ-साथ data protection, privacy, cyber security और sensitive judicial data को अलग-अलग safeguards के रूप में रखा है। Draft framework sensitive judicial data में parties, witnesses और legal representatives की personally identifiable information तथा court process से जुड़ी ऐसी information को शामिल करता है जिसका unauthorised disclosure harm पैदा कर सकता है।

मतलब साफ है:

AI को blindly सब कुछ देना responsible legal practice नहीं माना जा सकता।

Party-in-Person के लिए खतरा और भी practical है

जब कोई व्यक्ति खुद अपना case लड़ रहा होता है, तो वह सोच सकता है:

“मैं lawyer को पैसे क्यों दूँ? AI से draft बनवा लूंगा।”

लेकिन legal drafting केवल English sentences बनाने का नाम नहीं है।

Case की facts, evidence, limitation, procedure, relief, jurisdiction, previous orders और strategy आपस में जुड़ी होती हैं।

AI आपके सामने बैठकर आपकी पूरी file की human responsibility नहीं लेता।

A husband receives dozens of WhatsApp messages during a matrimonial dispute.

Some contain threats.
Some contain settlement discussions.
Some show that he was repeatedly asking for reconciliation.
Some may contain completely different versions of what happened.

Then, in frustration, someone deletes the entire chat.

यहीं से एक practical problem शुरू हो सकती है.

In a CAW CELL DELHI, matrimonial complaint, divorce proceeding, DV case or matrimonial FIR, electronic material can become relevant — but simply having a screenshot on your phone does not automatically answer every evidentiary question.

The Delhi High Court has notified Electronic Evidence and Video Conferencing Rules, 2025, specifically to consolidate and streamline procedures relating to electronic evidence and electronic communication in court proceedings. The Rules recognise the use of electronic means across criminal and civil proceedings.

That means a husband dealing with CAW Cell Delhi / Crime (Women) Cell / Delhi NCR matrimonial litigation should start thinking differently about his digital record.

WhatsApp chats. Emails. Call recordings. Voice notes. Photographs. Videos. CCTV footage. Bank messages. Location-related records.

इन सबको सिर्फ “फोन में पड़ा हुआ material” समझकर छोड़ देना हमेशा practical नहीं होता.

Suppose a matrimonial complaint says that the husband never contacted his wife after separation.

But his WhatsApp history contains repeated messages asking her to return.

Or a complaint alleges one particular conversation took place on a certain date, while the available messages show a completely different sequence.

Or there is an allegation about a threatening call, but the husband has the original recording and surrounding communications that provide important context.

The question then becomes:

This distinction matters because electronic evidence can raise questions about authenticity, source, integrity and the manner in which the material is produced before Court.

Delhi’s Electronic Evidence Rules were introduced precisely against the background that courts increasingly deal with electronic communication and audio-video material.

So if a matrimonial complaint in Delhi has just been made against you, do not immediately start deleting old conversations because they are emotionally disturbing.

पहले record को preserve कीजिए.

Do not casually edit screenshots.

Do not forward everything to dozens of people.

Do not alter the original files.

Do not assume that a cropped screenshot will always tell the whole story.

And do not wait until a lawyer asks, “Where is the original?” after months have already passed.

For a husband facing 498A/406 allegations, CAW Cell proceedings, DV proceedings, divorce litigation or other family disputes, a chronological digital record can sometimes be far more useful than a folder containing random screenshots.

यह वह situation है जिसमें एक husband धीरे-धीरे टूटने लगता है। Divorce अभी final नहीं हुआ, कोई clear custody arrangement नहीं है, और meanwhile बच्चे Jodhpur, Vijayawada, Hyderabad, Bangalore जैसे अलग-अलग cities में चले जाते हैं। Father के लिए सवाल सिर्फ custody का नहीं रहता—“मैं अपने बच्चों की life में present कैसे रहूँ?”

Delhi High Court के एक detailed judgment ने इसी तरह की complicated custody battle को examine किया। Husband-father ने कहा कि separation के बाद बच्चों को लगातार अलग-अलग जगह ले जाया गया और उसके access तथा communication में बाधा आई। दूसरी तरफ mother ने अपने allegations और बच्चों की welfare को लेकर अलग case रखा। मामला इतना लंबा चला कि mother बाद में UK में रहने लगी जबकि बच्चे India में maternal grandparents के साथ रह रहे थे.

Court ने एक बहुत important बात कही—custody का फैसला सिर्फ इस आधार पर नहीं होता कि mother कौन है, father कौन है, किसकी income ज्यादा है या बच्चे किस parent के साथ पहले से रह रहे हैं। Paramount consideration बच्चों का welfare और best interest है। इस particular case में Court ने repeated relocation, sibling unity, parental relationship और overall circumstances को देखा और दोनों बच्चों की custody father को देने का निर्देश दिया।

Case-specific caution: यह Delhi High Court decision अपने particular facts, evidence, relocation history, existing proceedings और children’s welfare assessment पर आधारित था। इसका मतलब यह नहीं कि हर custody dispute में father को custody मिलेगी या every relocation by a parent गलत मानी जाएगी। हर case में बच्चे की actual welfare, existing orders, evidence और surrounding circumstances अलग से examine होते हैं।

Delhi NRI Husband: USA Settlement के बाद भी CAW Cell FIR?

“Matter तो USA में settle हो चुका था… फिर Delhi में FIR कैसे?”

This is not a hypothetical question.

It arose in a real Delhi High Court case in 2026.

In Nikunj Sanghani @ Nicunj Sanghani & Ors. v. State, Govt. of NCT of Delhi & Anr., the husband had married in New Delhi in 2017 and returned to the USA shortly afterwards for employment.

His wife later joined him in the USA.

Then the matrimonial relationship broke down.

The husband filed divorce proceedings before the Superior Court of New Jersey.

But the dispute did not remain in the USA.

While the US proceedings were continuing, the wife initiated proceedings in India, including:

Domestic Violence proceedings

and a complaint before the

CAW Cell, Delhi.

Later, an FIR under Sections 498A/406/34 IPC was registered in Delhi.

Now came the complicated part.

The husband and his family relied upon documents showing that the parties had entered into settlement arrangements in the USA.

They relied upon a Property Settlement Agreement and a US divorce decree.

According to their case, the settlement had already resolved the matrimonial and financial disputes, including a payment of approximately US $15,000 as full and final settlement.

Yet the Indian criminal proceedings continued.

The petitioners argued that the wife had accepted the benefits of the US settlement and divorce while simultaneously pursuing criminal proceedings in India arising from the same matrimonial dispute.

The Court examined the chronology.

And there was another unusual feature.

The judgment records that during one episode of alleged domestic violence in the USA, the husband himself had been identified by the US police as the victim; he ultimately did not pursue that complaint.

The Court also examined earlier agreements between the parties, including arrangements concerning their married life and finances.

After examining the material, the Delhi High Court concluded that continuation of the Indian criminal proceedings in the circumstances of this case amounted to an abuse of the process of law and quashed the FIR and consequential proceedings.

Now pause here.

This case does not mean:

“Every NRI husband who gets a foreign divorce can automatically stop an Indian FIR.”

Absolutely not.

The case turned on its particular facts, documents, chronology and settlement.

And that is exactly why an NRI husband needs to preserve everything.

US divorce papers.

Property Settlement Agreement.

Proof of payment.

Emails.

WhatsApp conversations.

Foreign police records.

Court orders.

CAW Cell complaints.

Indian FIR.

Statements made by both sides.

Because when matrimonial litigation crosses borders, one country's document can become highly relevant to proceedings in another country.

और यहाँ सबसे बड़ा mistake क्या हो सकता है?

“मेरे US lawyer के पास सब है, Indian lawyer को बाद में दे देंगे.”

No.

Give your Indian counsel the complete chronology.

Not a two-line summary.

Not:

“Sir, everything was settled abroad.”

Give the entire record.

Because the real question may become:

What exactly was settled?

When was it settled?

What amount was paid?

Which claims were waived?

What did the parties agree to withdraw?

When did the Indian complaint/FIR arise?

What did the complainant disclose to the Indian authorities?

What did she not disclose?

That is where the case can change completely.

Sometimes the battle is about the chronology and documentary record.
